Eligibility: Sweepstakes (hereafter, “Promotion”) is open to legal residents of 49 states of U.S.A, (excludes Hawaii) who are 18 years of age or older as of the date of entry. Employees, officers, directors, agents and representatives of Springer Mountain Farms (“Sponsor”), and its respective parent company, subsidiaries, affiliates, governors, related entities, owners, distributors, retailers, and advertising/promotion agencies and of all their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, "Released Parties"),and each such individual’s immediate family members (mother, father, sister, brother, child, husband, wife and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. Void where prohibited by law. All applicable federal, state and local laws apply. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Larry’s Country Diner. How to Enter: 1) Visit https://www.betterchicken.com during the Promotion Period. Promotion Period begins 3:00pm Pacific Daylight Time, October 27, 2016 and ends 11:59pm Pacific Standard Time, January 25, 2017. Follow the prompts to complete and submit the Official Entry Form. Official Entry form shall be referred to hereafter as the “Entry". You may enter a maximum of one time each day; more than one entry in any day will not increase your chances of winning. The use of script, macro or automated devices (or any other devices intended to automate or subvert any aspect of entry) to enter the Promotion is prohibited and any Entry through such means and any Entry that is deemed to be ineligible (at Sponsor’s sole discretion and in accordance with these Official Rules) will be void. All entries become the exclusive property of the Sponsor and will not be acknowledged or returned. In the event of a dispute as to the identity of an entrant based on the e-mail address submitted, Entry will be awarded to the person named on the applicable Official Entry Form (regardless of whether that is the name of the authorized account holder of the email address from which said entry form was submitted), provided such individual is eligible according to these Official Rules.
Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, damaged, inaccurate, or undelivered Entries, or for telephonic, human or computer failures, problems or errors, defects or delays in any transmission, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Promotion, including, without limitation, errors which may occur in connection with the administration of the Promotion, the processing of Entries, the announcement of the prizes or winners, for any injury or damage to entrant’s or any other person’s computer relating to or resulting from participation in this Promotion, or for printing, typographical, human or other errors appearing in these Official Rules or other Promotion-related materials. Sponsor reserves the right, in its sole discretion, to void any entries of entrants and disqualify such entrants whom Sponsor believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Promotion and/or who are in violation of these Official Rules.
If Entry contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, in Sponsor’s sole discretion, render Entry null and void.
By submitting an Entry, each entrant agrees Sponsor shall own the Entry submitted (including the copyright thereto and all rights embodied therein) and that it and its designees may exploit, edit, modify, and distribute the Entry and all elements of such Entry, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to entrant or any third party.
By submitting an Entry, entrant hereby grants the Released Parties, without any limitation of any other rights granted herein, permission for the Entry to be posted on https://www.betterchicken.com and other websites as determined by Sponsor. Entrant agrees that Released Parties are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry and may remove a posted Entry at any time.
Winner Selection: Potential winners will be selected in a random drawing on or about October 27, 2016, from among all eligible entries received. Drawing decisions will be final and binding in all matters relating to this Promotion. Odds of winning any prize will depend on the number of eligible entries received. All winners will be notified by telephone, mail and/or email and may be required to execute and return a Declaration of Eligibility, Liability and (where legal) Publicity Release within seven (7) days of date of issuance of notification. Noncompliance with the foregoing or with these Official Rules, any notification being returned as non-deliverable, or Sponsor’s inability to contact a potential winner within a reasonable time period, may result in disqualification and, at Sponsor’s sole discretion and time permitting, an alternate winner being selected for the drawing at issue. Limit (1) Prize per person, family, or household.
Prizes: (1) Grand Prize: One bunker style freezer (Sponsors pick) and 100 lbs of Springer Mountain Farms fresh frozen chicken. Exact details of prizes awarded are at Sponsor’s sole discretion. All costs and expenses associated with the acceptance and use of the prize not specified herein as being awarded, including, but not limited to, all federal, state and/or local taxes are each winner’s sole responsibility. All prizes provided by Sponsor.
Miscellaneous: No transfer, assignment, cash redemption, or substitution of prize (or portion thereof) is permitted except by Sponsor who reserves the right to substitute a prize (or applicable portion thereof) with one of comparable or greater value, at its sole discretion and except as otherwise provided herein. Entrants agree, by entering, that 1) Sponsor and its designees may use (unless prohibited by law) entrant’s name, city and state of residence, trade and/or any other purposes in any media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification, and 2) the Released Parties shall have no liability and will be held harmless by entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize and any activity, travel or travel-related activity thereto or participation in this Promotion. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Promotion (or portion thereof) for any reason, including if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Promotion or for any other reason and, in the case of termination, at its discretion, select the winners from among all eligible non-suspect entries received for the prior to the event that required such termination. CAUTION: Any attempt to deliberately damage the website or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
